These Terms of Service ("Terms") govern your access to and use of healthysprays.com (the "Site"), operated by Healthy Sprays LLC ("Healthy Sprays," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
The Site provides general information about Healthy Sprays and its products for educational and program-information purposes only. Nothing on the Site is medical advice, a diagnosis, or a treatment recommendation, and it is not a substitute for consultation with a licensed healthcare provider. Always seek the advice of a qualified provider with any questions about a medical condition or medication. Never disregard or delay seeking professional medical advice because of something you read on the Site.
Using the Site — including submitting a form or completing an eligibility questionnaire — does not create a doctor-patient relationship between you and Healthy Sprays. Healthy Sprays is a product brand and does not practice medicine, provide telehealth services, or prescribe or dispense medication. Telehealth evaluations and prescribing are provided independently by licensed providers via PrescriberNow, and any medication is dispensed by licensed pharmacies. A provider-patient relationship, if any, is formed only with the treating provider through the PrescriberNow platform.
THIN®, THIN-R®, and THIN-ST® are compounded, prescription-only medications prepared for an individual patient pursuant to a valid prescription. Compounded drugs are not FDA-approved and are not reviewed by the FDA for safety, effectiveness, or manufacturing quality. A product will be dispensed only if an independent licensed provider evaluates you and determines it is medically appropriate.
Completing an evaluation, submitting information, or making any payment does not guarantee that you will be prescribed or receive any medication. The decision to prescribe rests solely with the independent treating provider based on their clinical judgment. If a provider determines that a product is not appropriate for you, you will not receive it, and any applicable fees will be handled according to the provider's or pharmacy's policies.
You must be at least 18 years old and located in the United States to use the Site and request an evaluation. By using the Site, you represent that you meet these requirements and that the information you provide is accurate and complete.
THIN®, THIN-R®, and THIN-ST® are registered trademarks of Healthy Sprays LLC. All content on the Site — including text, graphics, logos, images, and design — is owned by or licensed to Healthy Sprays and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written permission. Ozempic®, Wegovy®, and Mounjaro® are trademarks of their respective owners; Healthy Sprays is not affiliated with, endorsed by, or sponsored by them.
You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, scraping or harvesting data, or using it for any unlawful purpose or in violation of these Terms.
The Site links to and relies on third parties, including PrescriberNow (telehealth and prescribing) and dispensing pharmacies. Your use of those services is governed by their own terms and privacy policies. Healthy Sprays is not responsible for the acts, omissions, content, or services of any third party.
The Site is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any information on it is complete or current.
To the fullest extent permitted by law, Healthy Sprays LLC and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of (or inability to use) the Site, even if advised of the possibility of such damages. To the extent liability cannot be excluded, our total aggregate liability arising out of or relating to the Site will not exceed one hundred U.S. dollars (US$100). Nothing in these Terms limits liability that cannot be limited under applicable law.
You agree to indemnify and hold harmless Healthy Sprays LLC and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or your violation of these Terms.
These Terms are governed by the laws of the State of [STATE], without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in [STATE].
We may update these Terms from time to time. Changes are effective when posted, and we will revise the "Last updated" date above. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
