1. Acceptance of These Terms

These Terms of Service ("Terms") are a binding agreement between you and Healthy Sprays LLC ("Healthy Sprays," "we," "us," or "our") governing your access to and use of healthysprays.com, including its pages, quizzes, forms, and portal areas (collectively, the "Site"). By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Site.

2. Eligibility

The Site is intended for individuals who are at least 18 years old and located in the United States. By using the Site, you represent that you meet both requirements. The Site is not directed to children, and we do not knowingly collect information from anyone under 18.

3. Description of the Service — Informational Only; No Sales on This Site

The Site is an informational and marketing website for THIN™, THIN-R™, and THIN-ST™, which are prescription-only compounded medications. No sales occur on this Site. We do not operate a cart or checkout, and we do not accept payment for medication here. If you choose to pursue treatment, the telehealth evaluation, any prescribing decision, payment, and fulfillment occur through PrescriberNow and independent licensed providers and pharmacies, under their own terms, consents, and privacy practices — not under these Terms. Healthy Sprays is a product brand; it does not practice medicine, provide telehealth services, or dispense medication.

4. No Medical Advice; No Doctor-Patient Relationship

Content on the Site is provided for general educational and program-information purposes only. It is not medical advice, a diagnosis, or a treatment recommendation, and it is not a substitute for consultation with a licensed healthcare provider. Using the Site — including reading content, submitting a form, or completing a quiz — does not create a doctor-patient relationship between you and Healthy Sprays. Any provider-patient relationship is formed, if at all, only with an independent treating provider through the PrescriberNow platform. Never disregard or delay seeking professional medical advice because of something you read on the Site. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.

5. Medication Disclosures

THIN™, THIN-R™, and THIN-ST™ are compounded medications prepared by state-licensed 503A compounding pharmacies for an individual patient pursuant to a valid prescription. You understand and acknowledge that:

• Compounded medications are not FDA-approved and are not reviewed by the FDA for safety, effectiveness, or manufacturing quality.
• An evaluation and independent clinical review by a licensed provider is required before any prescription may be issued.
• Making a payment (to PrescriberNow, a provider, or a pharmacy) does not guarantee that you will receive a prescription; the decision to prescribe rests solely with the treating provider.
• Individual results vary, and no particular outcome can be promised or guaranteed.

6. Quizzes and Interactive Tools

Any eligibility quiz, questionnaire, calculator, or similar tool on the Site is an educational screener only. These tools do not diagnose any condition, do not determine whether you will be prescribed anything, and do not constitute a medical evaluation. Only an independent licensed provider, after reviewing your health information through PrescriberNow, can determine whether treatment may be appropriate for you.

7. Accounts and Pharmacy Partner Portal

Most of the Site requires no account. The pharmacy partner portal is made available only to businesses that have a contract with Healthy Sprays, and access is limited to authorized representatives of those businesses. If you are issued credentials, you are responsible for keeping them confidential and for all activity under your account, and you agree to notify us promptly of any suspected unauthorized use. We may suspend or revoke portal access at any time, with or without notice, including where we believe credentials have been shared or misused or a contract has ended.

8. Intellectual Property

THIN™, THIN-R™, and THIN-ST™, the Healthy Sprays name and logos, and all content on the Site — including text, graphics, images, page designs, and code — are owned by or licensed to Healthy Sprays LLC and are protected by trademark, copyright, and other intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your personal, non-commercial use. You may not copy, reproduce, republish, distribute, scrape, harvest, frame, or create derivative works from the Site or its content without our prior written permission, and you may not use any automated means (including bots or scrapers) to access or extract data from the Site.

9. User Submissions

When you submit information through a form on the Site — such as a contact request, quiz response, or pharmacy partner inquiry — you certify that the information you provide is accurate and complete, and that you are the person (or an authorized representative of the business) it describes. You grant us the right to use the contact information you provide to respond to your inquiry and to send you related informational and marketing communications, as described in our Privacy Policy. You can opt out of marketing communications at any time.

10. Third-Party Links and Services

The Site links to and works with third parties, including PrescriberNow (telehealth intake, evaluation, and fulfillment coordination) and analytics and advertising partners (such as tracking pixels described in our Privacy Policy). Third-party sites and services are governed by their own terms and privacy policies, and we do not control and are not responsible for their content, acts, omissions, or practices. A link from the Site does not imply our endorsement.

11. Disclaimer of Warranties

THE SITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION ON IT IS COMPLETE, ACCURATE, OR CURRENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HEALTHY SPRAYS LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID TO HEALTHY SPRAYS ON THIS SITE (WHICH, BECAUSE NO SALES OCCUR ON THIS SITE, IS $0). NOTHING IN THESE TERMS LIMITS ANY LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

13. Indemnification

You agree to indemnify, defend, and hold harmless Healthy Sprays LLC and its members, officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Site, your violation of these Terms, your violation of any law or the rights of a third party, or any inaccurate information you submit through the Site.

14. Termination

We may suspend or terminate your access to the Site (including portal access) at any time, with or without notice, if we believe you have violated these Terms or applicable law, or to protect the Site, our users, or our partners. Sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

15. Governing Law; Venue; Dispute Resolution

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. You agree that any such dispute will be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.

Informal resolution first. Before filing any claim, you agree to first contact us at cs@healthysprays.com with a written description of the dispute and to work with us in good faith for at least thirty (30) days to try to resolve it informally.

Class-action waiver. To the fullest extent permitted by law, you and Healthy Sprays each agree that any dispute will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

Severability. If any provision of these Terms (including any part of this section) is found unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

16. Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted on this page, and we will revise the effective date above. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. If a change is material, we may take additional reasonable steps to notify you, such as a notice on the Site.
